Resolution about Sunrise provision in new TLDs
Because language is the common propoerty of mankind, the right of persons to make legal uses of letteres or words, especially non-commercial uses, should receive protection in every respect equal to that afforded to holders of special, limited geographic or sectoral rights in registered marks.
In new top-level domains that are unrestricted generic TLDs, the non-commercial constituency opposes so-called "sunrise" arrangements or any other policies that privilege trademark holders over other users and undermine fair use rights in names. We urge the ICANN board to make amendments as necessary to existing applications.
